Washington Biometric Data Privacy Policy

The Behavior Analyst Certification Board, Inc. (“BACB”) respects the privacy of your “consumer health data” as defined by Washington state law. This Washington Biometric Data Privacy Policy (“Policy”) is designed to assist you in understanding how we collect, use, share, and safeguard your consumer health data. This Policy applies to Washington residents who take a BACB examination in a Pearson VUE test center. This Policy applies in addition to our Privacy Policy.

1. Categories of Consumer Health Data We Collect

The BACB’s test vendor, PearsonVUE, collects palm vein scans from examination candidates on behalf of the BACB for the purpose of test security. Although inferences about health cannot be made based solely on palm vein scans, they may be considered consumer health data as defined by Washington state law.

2. Categories of Sources from Which We Collect Consumer Health Data

PearsonVUE receives palm vein scans directly from you.

3. Sharing of Consumer Health Data

PearsonVUE does not share the palm vein scans it collects.

4. Your Privacy Rights

Under applicable law, you may have certain privacy rights regarding your consumer health data, including the right to:

  • Confirm whether we are collecting, sharing, or selling your consumer health data;
  • Access your consumer health data;
  • Withdraw your consent from our collection of your consumer health data; and
  • Delete your consumer health data.

To exercise your rights, please submit a request through the Personal Data Removal Request form found in Section 10 of the BACB’s Privacy Policy. If legally required, we will comply with your request upon verification of your identity. To do so, we will ask you to verify data points based on information we have in our records. If we refuse to take action regarding your request, you may appeal our decision by completing the Administrative Appeal Request Form.
